The Northern District of Georgia is one of Georgia's three federal judicial districts. Under 28 U.S.C. 90, it has four divisions: Atlanta; Gainesville; Rome; Newnan. The Atlanta Division includes the five counties covered in detail here: Clayton, Cobb, DeKalb, Fulton and Gwinnett. Federal judicial geography should not be confused with a definition of metro Atlanta.[1]

Atlanta Division geography

Section 90 also places Cherokee, Douglas, Henry, Newton and Rockdale counties in the Atlanta Division and provides for court to be held in Atlanta. Forsyth County, although relevant to the Georgia 400 corridor, is in the Gainesville Division under that statute. A regional road can therefore cross the boundaries of federal divisions.[1][2]

Federal jurisdiction and removal

One possible basis for federal civil jurisdiction is diversity of citizenship under 28 U.S.C. 1332. That provision includes an amount in controversy exceeding $75,000, exclusive of interest and costs, and specified citizenship requirements. It does not make every high-value crash claim a federal case merely because a truck or interstate highway was involved.[3]

Section 1441 addresses removal of qualifying civil actions from state court by defendants to the federal district and division embracing the state-court location. It also contains a restriction for certain diversity cases involving a properly joined and served defendant who is a citizen of the forum state. These are statutory conditions, not a prediction that a particular case can be removed.[4]
